Today, a formal
ceremony was held to sign a Memorandum of Cooperation between the Prosecutor
General’s Office of the Republic of Kazakhstan and the Kazakhstan Foreign
Investors’ Council Association (KFICA).
The document was
signed by Prosecutor General Berik
Assylov and Chairman of the KFICA Board Erlan Dosymbekov.
The event
brought together senior officials from the Prosecutor General’s Office, the
Ministry of Foreign Affairs of the Republic of Kazakhstan, Kazakh Invest, as well as members of the KFIC
Board and Executive Committee — executives and representatives of leading
international companies, including EY, Chevron, CNPC,
Philip Morris International, Wabtec, Eurasian
Development Bank, Solidcore Resources plc,
Sembol Construction, RUSAL, Air Liquide
Munay Tech Gases, Eni Kazakhstan, Almaty International Airport, ERG, Shell,
Citi, KPMG
and PwC.
In his remarks,
Berik Assylov emphasized that attracting investment is a matter of national
importance, and that the prosecution authorities, guided by the principle of
“Law and Order,” are shifting from a reactive approach to violations toward a
system-based prevention of business-related issues.
Over the past
three years, the number of criminal cases registered against entrepreneurs has
decreased fourfold, or by 71.5%.
In the current
year, compared to the first quarter of 2025, the number of administrative
proceedings for obstruction of business activities (Article 173 of the Code of
Administrative Offenses) has tripled, increasing from 16 to 50.
The development
of mechanisms for protecting business rights is viewed as inseparable from
digitalization and the adoption of artificial intelligence technologies, in
line with the strategic course set by the President of the Republic of
Kazakhstan, Kassym-Jomart Tokayev.
At present, the
prosecution authorities oversee approximately 3,000 investment projects with a
total value of KZT 100 trillion. As a result of the measures taken, more than
250 projects have already been launched, creating 30,000 jobs.
“The signing of
the Memorandum elevates our cooperation with the international business
community to a fundamentally new level. A permanent direct communication
channel between the прокуратура and
the Association will be established, enabling the prompt removal of
administrative barriers,” the Prosecutor General noted.
Chairman of the
KFICA Board Erlan Dosymbekov expressed appreciation for the openness to
dialogue and highlighted the importance of new institutional mechanisms for
protection.
“We highly value
the assignment of the Investment Ombudsman functions to the Prosecutor General
and the establishment of a specialized Committee. This is a timely and
systematic step aimed at strengthening guarantees for the protection of rights
and increasing the confidence of the international business community,” he
stated.
The parties
expressed confidence that the Memorandum will serve as a clear signal to the
global community that Kazakhstan ensures a reliable jurisdiction, implements
best international practices, and provides stability for investors.
The ceremony
concluded with presentations on key areas of activity by the Committee for the
Protection of Investors’ Rights under the Prosecutor General’s Office of the
Republic of Kazakhstan, delivered by Committee Chairman Yeraly Bauyrzhan
Beibituly; the Investment Committee of the Ministry of Foreign Affairs of the
Republic of Kazakhstan, presented by Deputy Chairman Yevgeniy Kim; and Kazakh Invest, presented by Deputy Chairman of
the Management Board Aibol Argyngazinov. The presentations outlined existing
mechanisms for supporting investment projects and protecting investors’ rights,
followed by a substantive exchange of views between investors and government
representatives on current issues of the investment climate.
